1. Service description

tviy.ai (the "Service") is a voice AI assistant platform for businesses. The Service provides functionality for automating communication with customers, including taking calls and messages, handling bookings, calendar synchronisation, managing business information, and displaying data in the user's personal cabinet.

The Service operates on the basis of artificial intelligence and integrates with the user's own accounts, including Google Calendar, if the user independently grants the appropriate permission.

2. Account and access

To use the full functionality of the Service, the user must create an account, provide reliable contact details, and confirm the registration. The user is responsible for keeping their credentials confidential and for all actions taking place in their account.

The Service may provide temporary access without registration so that it can be evaluated. Such temporary access has a limited lifetime, and its data is deleted if the user does not complete the registration.

3. Acceptable use

The user agrees to use the Service only for lawful purposes and in accordance with these Terms. The following is prohibited:

  • using the Service for fraud, spam, or the dissemination of misleading information;
  • attempting to obtain unauthorised access to the Service's infrastructure;
  • uploading malicious code, viruses, or other threats;
  • using the Service in violation of the rights of third parties or of the applicable law of Ukraine.

4. AI responses and limitation of liability

The AI assistant generates responses on the basis of the information provided by the user and the rules configured for the business. tviy.ai makes efforts to ensure that responses are accurate and useful, but does not guarantee the absolute accuracy of every response.

The AI assistant is not a medical professional, a lawyer, or any other qualified specialist. It does not diagnose conditions, does not give medical advice, and does not replace professional advice. The user is required to escalate complex or critical questions to a human specialist.

5. Appointments and bookings

The Service allows appointments to be created, rescheduled, and cancelled. All operations are carried out on the basis of the information provided by the user and the availability of time slots in the clinic's schedule or the connected calendar.

tviy.ai is not liable for booking errors that arise from incorrect information about the schedule, services, prices, or contact details entered by the user.

6. Google Calendar integration

At the user's request, they may connect their Google Calendar to the Service. Once connected, the Service is given access to calendar information solely in order to:

  • check how busy the time slots are;
  • create, update, and delete events related to appointments;
  • synchronise the schedule between the Service and Google Calendar.

The user can revoke access to Google Calendar at any time through the settings of their Google account. tviy.ai does not use Google Calendar data for any other purpose and does not pass it to third parties.

7. The user's responsibility for business information

The user is fully responsible for the accuracy, completeness, and currency of the business information provided in the Service, including:

  • the name, address, and contact details of the establishment;
  • the list of services, prices, and appointment duration;
  • the schedules of specialists/employees, breaks, and days off;
  • the booking and cancellation rules and any other instructions for customers.

The AI assistant speaks to customers on the basis of this information alone. If the data is outdated or incorrect, tviy.ai is not liable for any misunderstandings with customers.

8. Third-party services

The Service relies on providers of cloud infrastructure, voice technologies, email, and other supporting services. These providers process data on behalf of tviy.ai under data processing agreements. The Service does not pass user data to advertising networks or other third-party organisations.

9. Service availability

tviy.ai aims to keep the Service running without interruption but does not guarantee 100% availability. Interruptions may occur because of maintenance, updates, force majeure, or problems with third-party providers. tviy.ai will make reasonable efforts to restore the Service as soon as possible.

10. Limitation of liability

The Service is provided "as is". tviy.ai is not liable for any direct, indirect, incidental, or other loss arising from the use of, or the inability to use, the Service, including but not limited to loss of profit, data, or business reputation.

To the extent permitted by applicable law, tviy.ai's total liability is limited to the amount the user paid for the use of the Service over the last 12 months, or, where no such payment was made, to the minimum liability limit.

11. Suspension or termination of access

tviy.ai may suspend or terminate a user's access to the Service if these Terms are breached, if unauthorised access is attempted, or in the case of any other conduct that harms the operation of the Service or third parties. The user may delete their account at any time by contacting the support service.

12. Amendments to these Terms

tviy.ai may update these Terms from time to time. The user will be notified of material changes through the Service interface or by email. Continuing to use the Service after the changes have been made means accepting the updated Terms.

13. Governing law

These Terms are governed by the law of Ukraine. All disputes are resolved by negotiation and, where agreement cannot be reached, in the competent court at the location of tviy.ai.
