Public Agreement (Offer)

1. General provisions

1.1. This document is a public agreement (offer) for the provision of services under Articles 633 and 641 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce".

1.2. Contractor (Seller): ФОП Ящук Оксана Василівна / Private Entrepreneur Iashchuk Oksana, Tax ID / EDDRPU 2818607364, acting on the basis of the entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Non-Profit Organisations.

1.3. This offer is addressed to an unlimited number of persons and is deemed accepted from the moment the Customer pays for the services on the tviy.ai website.

2. Subject matter of the agreement

2.1. The Contractor provides a digital service — access to the voice AI assistant platform for business (the "Service"), which automates the taking of calls and messages, appointment booking, calendar synchronisation, and management of business information.

2.2. The Service is digital content and is provided remotely through the Service's web interface. No physical transfer of goods takes place.

3. Procedure for entering into the agreement

3.1. The Customer chooses a tariff package of minutes on the payment page, checks the selected package, and makes the payment. The operation creates an order with a unique number (order reference).

3.2. The moment of acceptance is the moment the payment system confirms the payment. From that moment the agreement is deemed concluded and enters into force.

4. Price of the services and methods of payment

4.1. The price of the Service is determined by the selected tariff package of minutes and is shown on the payment page. Payment is made in hryvnia (UAH).

4.2. Methods of payment: bank cards of international payment systems (Visa, Mastercard), as well as other online payment methods available through the payment operator WayForPay (in particular Google Pay and Apple Pay), subject to their being supported by the Customer's payment infrastructure.

4.3. Once the order has been created, the Customer is given a link to a secure payment page. The invoice is valid for 24 hours from the moment it is created.

5. Timeframes and procedure for providing the services

5.1. The Service is activated automatically after the payment system confirms the payment: the purchased minutes are credited to the Customer's account balance. For Customers who get to know the Service without paying, the Service is provided in demonstration mode.

5.2. The purchased balance of minutes has no expiry date and is used until it is fully spent, unless otherwise stated on the payment page.

5.3. The Contractor makes efforts to keep the Service running continuously. Short interruptions for maintenance or updates may occur, and the Contractor notifies about them in advance through the Service interface.

6. Territory for the provision of services and delivery

6.1. Because the Service is digital and provided remotely, its provision is not restricted to a list of cities or countries: the Service is available at any point in the world where there is access to the Internet.

6.2. The Service does not physically deliver goods, and no delivery services are involved. The Service is provided in Ukrainian.

7. Refunds and cancellation of a transaction

7.1. The Service is digital content and is provided to the Customer immediately upon acceptance (payment confirmation). Under Part 2 of Article 9 of the Law of Ukraine "On Consumer Protection" and Article 12 of the Law of Ukraine "On Electronic Commerce", the consumer's right to withdraw from the agreement within 14 days does not apply to digital content that has been provided with the consumer's consent. In other words, there is no general refund procedure for a digital Service that has been duly provided.

7.2. A refund is given in the following cases:

• the payment was made by mistake, or the payment was not confirmed but the funds were debited;
• the Service was not activated for technical reasons on the Contractor's side;
• a refund has been agreed with the Contractor on an individual basis.

7.3. Refund procedure: the Customer sends a request to support@tviy.ai, stating the order number (order reference), the amount, and the circumstances. The Contractor considers the request within 10 business days. If the refund is approved, the money is returned to the payment instrument from which the payment was made within up to 14 business days from the date the decision is made.

7.4. Cancellation of a transaction: until the payment is completed, the Customer may abandon the payment without finishing it on the payment system page (the invoice is valid until the stated deadline). Once the payment is confirmed, the transaction cannot be cancelled — a refund is possible only under the procedure set out in clause 7.3 of this offer.

8. Liability of the parties

8.1. The parties are liable in accordance with the law of Ukraine in force. The Contractor is not liable for losses caused by inaccurate information provided by the Customer, or by attempts to gain unauthorised access to the account.

8.2. The results of the AI assistant's work obtained by the Customer do not constitute medical, legal, or any other professional advice.

10. Final provisions

10.1. This agreement is governed by the law of Ukraine. All disputes are resolved by negotiation and, in the absence of agreement, in court in accordance with the jurisdiction determined by the law of Ukraine.

10.2. The Contractor may change this offer by notifying Customers through the Service interface. A new version takes effect from the moment it is published.

10.3. The invalidity of any single provision of this offer does not render its other provisions invalid.
